This checklist does not address the question of whether it is advisable to file the I-485, Application for Adjustment of Status to Lawful Permanent Resident, but is intended for current clients who have been referred to this list by Curran & Berger staff.

This is a comprehensive list of everything Curran & Berger will need to begin your Adjustment of Status. We realize you may have sent us some of this information already. In that case, you do not need to send it again.

This guide applies to lawful permanent residents who obtained "green card" status based on a marriage of less than two years at the time the applicant received this permanent resident status. If you are such an applicant, your alien registration card will indicate your two-year condition expiration date. The following documents must be filed during the three-month period immediately prior to the expiration date on your card. Failure to properly file will result in termination of your legal status and will lead to deportation.

Children who become permanent residents with you, who were also given conditional status, can file with you on the same form.  They should receive seperate receipt. 

The purpose of this procedure is to show the Immigration Service that your marriage was entered into in good faith, and that the marriage is still bona fide. If your marriage is no longer viable, or you are for some other reason unable to jointly file this application, you will be required to file a waiver application.

These guidelines are applicable for foreign nationals who are married to a U.S. citizen, are present in the United States  and originally entered the United States in lawful status.  If your foreign national spouse is not currently present in the United States or did not originally enter the United States on a valid visa, you should speak with an attorney.  Please note that you should also speak to an attorney if there are any criminal issues or a previous unfulfilled J visa two-year home residence requirement.
