However, please note that it is USCIS policy since August, 2003 to deny an I-485 Adjustment of Status application if the underlying I-140 petition is denied.  Although the I-485 may be re-opened later if there is a successful appeal of the I-140 decision, we generally recommend filing the I-140 first, waiting for it to be approved, and then filing the I-485 unless you have an H visa as a safety net or there is a specific need for speed that you have discussed with the attorney handling the case.
