Obama Administration Files Lawsuit Against Arizona Over Immigration Law PDF Print

On July 6, 2010, the Obama Administration announced that it is suing Arizona over its controversial immigration bill. The Arizona Immigration Law SB 1070 was set to be enforced on July 29, 2010. The Department of Justice is filing its lawsuit based on the principle that Arizona has overstepped its boundary by enacting immigration legislation. The complaint states, “In our constitutional system, the federal government has preeminent authority to regulate immigration matters. This authority derives from the United States Constitution and numerous acts of Congress...” The lawsuit does not seek to invalidate the entire Arizona immigration law. It targets sections 1 through 6 of the law, leaving alone sections about employment and the impounding of vehicles.

The Development, Relief and Education for Alien Minors Act (The "DREAM Act") is a bipartisan legislation pioneered by Senator Orin Hatch (R-UT) and Senator Richard Durbin (D-IL). This bill would qualify certain illegal alien students who graduate from US high schools, who are of good moral character, arrived in the U.S. as minors, and have been in the country continuously for at least five years prior to the bill's enactment, to be eligible for a 6 year long conditional path to citizenship. Within the six year period, a qualified student must have "acquired a degree from an institution of higher education in the United States or have completed at least 2 years, in good standing, in a program for a bachelor's degree or higher degree in the United States," or have "served in the uniformed services for at least 2 years and, if discharged, have received an honorable discharge."


This morning on July 1, 2010, President Obama gave his first speech on Comprehensive Immigration Reform overhaul laws, in which he said, “...we should stop punishing innocent young people for the actions of their parents by denying them the chance to stay here and earn an education and contribute their talents to build the country where they’ve grown up. The DREAM Act would do this, and that’s why I supported this bill as a state legislator and as a U.S. senator — and why I continue to support it as president.”
