Documents & Information to send to Curran & Berger to Prepare for Your Adjustment of Status Application

This checklist does not address the question of whether it is advisable to file the I-485, Application for Adjustment of Status to Lawful Permanent Resident, but is intended for current clients who have been referred to this list by Curran & Berger staff.

This is a comprehensive list of everything Curran & Berger will need to begin your Adjustment of Status. We realize you may have sent us some of this information already. In that case, you do not need to send it again.

Please note: It is important for us to have the most up-to-date information about you and your family.

Filing Fees for Adjustment of Status Application
The filing fee due to the Department of Homeland Security at the time of filing is $1010. This fee includes the I-485, Application for Adjustment of Status to Lawful Permanent Resident, the Biometrics appointment fee, the I-765, Application for Employment Authorization Document, and the I-131, Application for Travel Document. Please note that the fee is the same whether or not the applicant chooses to submit the I-765 or the I-131. This fee includes Employment Authorization and Travel Document extensions each year until the I-485 is approved. For clients of Curran & Berger, the filing fees are due in total before the date of filing.

The total filing fee for children under age 14 who are filing with at least one parent is $600. This fee includes Employment Authorization and Travel Document extensions each year until the I-485 is approved.

Documents and Information for the Adjustment of Status Application
The following is a list of documentation your attorney will need from you to file for adjustment of status to lawful permanent residence.

Please scan and email, or copy and send by mail. Faxes tend to be hard to read. If you have already sent us some of this information you do not need to send it again. If you have questions about any of the requested documentation, please include a note with the information you do send.

For Principal Applicant and all Dependent Applicants

  1. Color copy of biographic information page of passport;
  2. Copies of all other pages of passport;
  3. Copy of your most recent white I-94 entry card received upon entry to the U.S.;
    PLEASE NOTE: If you last entered the U.S. through Canada or Mexico and did not receive a new I-94 card, please send the date and place of your most recent entry.
  4. Six (6) passport-style photographs.  Please see PHOTOGRAPH SPECIFICATIONS on the Department of State website.  
  5. Copies of all I-797 approval notices received from the USCIS;
  6. Copies of I-20s (issued if you were ever in F-1 status in the U.S.), DS-2019s or IAP-66s (issued if you were ever in J-1 status), I-612 J waiver approval notices, as well as any documentation of your family members’ F-2 or J-2 status;
  7. Copy of your long-form birth certificate;
    PLEASE NOTE: Your birth certificate must include your name, date and place of birth, and the names of both your mother and father.  Please contact the paralegal assigned to your case if you have any questions about this requirement.
  8. Copy of your marriage certificate;
  9. Copies of any divorce certificates for you or your spouse;
 

PLEASE NOTE: If a document is not in English, then a certified translation is required. Our firm can order a translation for you at an additional cost, or you can have your document translated and certified using a translation certification statement, signed and notarized. Please contact the paralegal assigned to your case to obtain the translation certification statement. You may not translate your own documents, nor those of any family member.

For the Principal Applicant only

  1. Copies of your federal income tax return(s) for the past year (tax transcripts may be obtained from the IRS if you have not kept copies);
  2. Copies of your W-2s or 1099s (financial information) for the past year;
  3. Copies of your most recent pay statement.
 

Form G-325, Biographic Information

In order to access the form, you must have Adobe Acrobat Reader software. If you are unable to get to the form using the link above, you may need to download this free software first.

  1. Please complete the first page of Form G-325 for the principal applicant and all dependent applicants. Please print legibly, as our staff must be able to read your handwritten form.
  2. Please write “none” or “N/A” if the question is not applicable to you.
  3. The USCIS does not require a G-325 for children under the age of 14, however our staff needs the information to complete other forms. Please include a completed form for all children, regardless of age.
  4. You do not need to sign the G-325. We will send you finalized version of all forms by mail for your signature.
  5. Please leave blank the field for “File Number” and “A Number” unless you received this number when previously applying for permanent resident status.

Form I-485, Application for Adjustment of Status - Page 3

  1. You only need to print and fill out page 3 of this form.  We will send you the completed form for signature.
  2. Please complete page 3 of Form I-485 for the principal applicant and all dependent applicants. Please be sure to answer every question.
  3. If you have EVER had any problem entering the U.S., obtaining a U.S. visa, or ANY contact with the police in any country, please let us know.
 

Medical Examination

PLEASE NOTE: As USCIS medical examination results must have been obtained within one year at the date the Adjustment of Status Application is filed, it is recommended that you consult with your paralegal or attorney before making an appointment for your exam.

Each member of your family who is applying for adjustment of status is required to have a medical examination with a USCIS doctor. The exam results will be returned to you in a sealed envelope. Please return the envelope to us unopened. There is a vaccination requirement for the USCIS medical exam. Therefore, it would be helpful to bring any vaccination records you may have to the exam. If you do not have any vaccination records, you may be given inoculations during the exam. Please note that all applicants must have a tuberculin skin test during their USCIS medical exam. An X-ray is not a suitable substitute for the TB skin test.
